Resistance Is Crucial: Ted Cruz Suggests U.S. Supreme Court Justice Kennedy Resign

Texas Republican Sen. Ted Cruz, busy running for president of the United States, is suggesting that U.S. Supreme Court Justice Anthony Kennedy should consider seriously resigning his office.

Currently the court’s swing vote, he often has the power to determine on what side of the line controversial decisions fall, given that the court is otherwise divided four to four between doctrinaire liberals and strong conservatives. His resignation would give President Barack Obama the opportunity to swing the court to left for some time, making Cruz’s call seem on its face to be somewhat bizarre. Why would one of the Senate’s most conservative members – and one who considers himself a constitutional scholar – push for an action that would effectively hand control of the third branch of government to the liberals?

The answer lies in the quirky nature of Kennedy’s recent rulings, the best example of which came in the Obergefell case that decided the ban on marriage between same-sex couples was discriminatory.
