IRS: No Reason Trump Can’t Release His Tax Returns Because of Audit

Trump says he still won't and experts agree he's probably smart to hold onto them.

During Thursday night’s debate, Donald Trump said that he couldn’t release his tax returns because he’s being audited. That was news to the IRS, who said in a statement Friday that “nothing prevents individuals from sharing their own tax information.”

But don’t raise your hopes on seeing those returns any time soon. “I’m just going to put you people to rest,” Trump said Friday, “Until my audit is finished, very simple, you are not going to see anything.”

That may actually be a smart move, experts tell The Hill. Tax lawyer and former council in the Justice Department’s tax division Robert Kovacev said that if Trump releases his returns and the media focuses on certain transactions the IRS might scrutinize those transactions even further.

Dean Zerbie, national managing director of alliantgroup says it’s easy to understand why Trump wouldn’t want “1,000 people helping the IRS with their work.”

Another wrinkle today in the Trump-IRS saga: Trump said during the debate, “I’m being audited 12 years in a row, at least.”

In interview with C-SPAN set to air Sunday, IRS Commissioner John Koskinen said it’s “rare” for an individual to be audited every year. “Usually when there’s an audit, and it’s cleared up, if there are no other issues, it’s a number of years, two or three at least, before you hear from us again, unless something in your next return pops up.”

Trump also speculated after the debate that the reason he’s being targeted every year is because he is a “strong Christian.” Not so, said Koskiken. “That’s something that would never cause you to be audited,” he said, “We don’t care who you are, who you voted for, what party you belong to, whether you go to church, or don’t go to church.”

Then again, as Dr. Ben Carson pointed out Thursday night, he had never gotten audited by the IRS until he challenged President Obama at the National Prayer Breakfast.
