House Committee To Hold Impeachment Hearings for IRS Commissioner Over ‘Misconduct’ in Targeting Scandal Investigation

House Republicans have announced they will hold hearings to consider impeaching IRS Commissioner John Koskinen. Koskinen has been accused of interfering with Congress’ investigations into the tax agency’s targeting of Tea Party and pro-life groups.

“Despite repeated congressional efforts to get to the bottom of this matter, Obama Administration officials, including the IRS Commissioner, have consistently undermined the investigation,” House Judiciary Committee Chairman Bob Goodlatte (R-VA) said in a statement announcing the hearings on Friday. “Over the coming weeks, the House Judiciary Committee will closely examine Commissioner Koskinen’s misconduct and the implications of his actions.”

The committee says Koskinen — who took over the top job after the IRS was discovered targeting conservative groups in May 2013 — is believed to have lied to Congress under oath, not complied with a subpoena and failed to inform Congress that e-mails of former IRS official Lois Lerner were missing.

Lerner headed the arm of the IRS that targeted conservatives. She retired with a taxpayer-funded pension four months after the scandal was made public. Last year, the Department of Justice refused to pursue criminal charges against Lerner and other IRS officials, finding them only guilty of “substantial evidence of mismanagement, poor judgment and institutional inertia.”

As The Hill reported, the IRS responded to the hearings with the following statement:

Commissioner Koskinen and the IRS workforce remain focused on serving the nation’s taxpayers. In addition to completing a successful filing season this spring, we continue making progress on a number of important issues involving taxpayer service, tax enforcement and cybersecurity.

The hearings will take place next week and in June, after which the Judiciary Committee will decide how to move forward. The first hearing will consist of a panel presenting the findings of the House Oversight and Governor Reform Committee’s examination of Koskinen. Koskinen will also be invited as a witness.

The second hearing will include “outside experts to comment on the findings presented in the first hearing and whether further congressional action is warranted,” said the committee’s press release.

No witnesses have been announced yet, but the hearings drew praise from the House Freedom Caucus, a conservative arm of the House GOP.

“Commissioner Koskinen must be held accountable for years of stonewalling Congress’ oversight efforts, obfuscating justice, providing false testimony before Congress, and failing to hold agency officials liable for unlawfully targeting groups based on their beliefs,” said the group.

Caucus Chairman Jim Jordan (R-OH) said that Koskinen “has most assuredly violated the public trust.”

“It’s time for him to go,” said Jordan.

Jenny Beth Martin, president and co-founder of Tea Party Patriots, one of the dozens of groups targeted by the IRS, was quoted by The Hill as saying that “we hope the facts uncovered by the House Judiciary Committee in these hearings will lead to impeachment proceedings against John Koskinen for his misconduct as IRS Commissioner.”

Thomas More Society Special Counsel Sally Wagenmaker, whose group represented several organizations targeted by the IRS, told The Stream that the hearings “underscore the importance of holding the IRS — and its leadership — accountable for processing tax-exemption applications and monitoring tax-exempt organization’s activities.”

“In prior years, several pro-life groups fell subject to the IRS’s improper scrutiny, delays, and violations of their First Amendment rights,” continued Wagonmaker. “As Susan Martinek testified before a Congressional panel in June 2013, her Coalition for Life of Iowa’s story is a cautionary tale of how the IRS can abuse small groups of dedicated volunteers, through threatening their First Amendment rights of free speech, religion and freedom of assembly.”

Democrats on the House Judiciary Committee did not immediately respond to a request for comment from The Stream.
